(dev.hamez.cropcare), web platform (trycropcareai.com), API services, or any
related services (collectively, the "Services"), you agree to be bound by these
Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use
the Services.
2. DESCRIPTION OF SERVICE
CropCare AI is a comprehensive agricultural technology platform that provides:

- AI-powered plant disease detection using GitHub Models API
- Image analysis for crop health assessment and disease identification
- Treatment recommendations (natural, chemical, and cultural practices)
- Local analysis history storage using encrypted Hive database
- Subscription-based access with regional pricing (developed/underdeveloped regions)
- Universal Link support (https://trycropcareai.com/) for seamless web integration
WEB PLATFORM (trycropcareai.com):
- Advanced dashboard and analytics for crop health management
- Team collaboration features for agricultural organizations
- Enterprise-grade reporting and data export capabilities
- API access and documentation for developers and integrators
- Multi-language support and global accessibility
SUBSCRIPTION PLANS:
- Free Tier: 5 AI scans per month with basic features
- Free Trial: 30-day trial with 1000 scans/month and full premium features (mobile-only, one per user)
- Premium Monthly: Unlimited scans, disease outbreak alerts, advanced features
- Premium Yearly: Annual subscription with 17% savings and full feature access
- Organisation Subscriptions: Paystack recurring billing with license-based team access

- Results are estimates based on image analysis and may contain errors or inaccuracies
- Confidence scores are AI-generated probability estimates, not validated accuracy guarantees
- Analysis quality depends on image quality, lighting conditions, and plant presentation
3.2 NO GUARANTEE OF RESULTS OR OUTCOMES
- We do not guarantee the accuracy, completeness, or reliability of AI analysis results
- Plant identification and disease detection may be incorrect or incomplete
- Treatment recommendations are informational suggestions only, not professional agricultural advice
- Results may vary based on regional plant varieties, local growing conditions, and environmental factors
- AI models are continuously improving but may have limitations in detecting rare or emerging diseases
3.3 PROFESSIONAL CONSULTATION REQUIREMENT
- ALWAYS consult qualified agricultural experts, plant pathologists, or extension services for critical plant health decisions
- For commercial crops, valuable plants, or food production, seek professional diagnosis before treatment
- Do not rely solely on AI analysis for pest control, disease management, or treatment decisions
- Local agricultural authorities should be consulted for region-specific treatment recommendations and regulatory compliance
3.4 SERVICE AVAILABILITY AND TECHNICAL LIMITATIONS
- AI analysis requires internet connectivity and depends on third-party service availability
- Service interruptions may occur due to maintenance, technical issues, or third-party provider limitations
- Analysis processing times may vary based on network conditions and server load
- Free tier users are subject to monthly scan limits (10 scans) with overage restrictions
- Premium features require active subscription validation through app store services

- This platform represents advancing agricultural technology with continuous improvements
- AI models are regularly updated and refined, which may affect analysis consistency over time
- New features and capabilities are added regularly, potentially changing user experience
- Beta features may be available with additional disclaimers and limitations
- User feedback and real-world performance data help improve service accuracy
4. USER RESPONSIBILITIES
4.1 ACCOUNT MANAGEMENT AND SECURITY
- Maintain accurate and current account information including email and regional settings
- Keep login credentials secure and notify us immediately of any unauthorized access
- You are responsible for all activities that occur under your account
- Comply with age restrictions (16+ years, parental consent required for minors)
- Ensure compliance with local laws and regulations regarding agricultural practices
- Grant or deny location permissions as desired for country code detection during signup
- Understand that location access is optional and used only for regional pricing and user experience
- Free trial is available only once per user, limited to mobile app activation
4.2 PROPER SERVICE USAGE
- Use the Services for personal, educational, or legitimate commercial agricultural purposes only
- Provide clear, well-lit, high-quality images for optimal AI analysis results
- Understand and acknowledge AI analysis limitations and seek professional consultation when appropriate
- Respect subscription limits: Free tier limited to 5 scans per month, trial users get 1000 scans per month, premium users have unlimited access
- Use reasonable bandwidth and do not attempt to overwhelm our servers with excessive requests
- Do not share trial or premium account access with other users
4.3 DATA AND CONTENT RESPONSIBILITIES
- Ensure you have permission to photograph and analyze plants you submit
- Do not upload copyrighted images, inappropriate content, or images containing personal information
- Verify AI recommendations with reliable agricultural sources and local experts
- Maintain backup copies of important analysis data as local storage may be lost during app updates or device changes
- Report any suspected errors or dangerous treatment recommendations immediately
4.4 SUBSCRIPTION AND BILLING COMPLIANCE
- Provide accurate billing information and maintain valid payment methods through app stores
- Monitor subscription status and usage limits through your account dashboard
- Cancel subscriptions directly through Google Play Store or Apple App Store as required
- Do not share premium account access or attempt to circumvent subscription limitations
- Comply with regional pricing structures and do not attempt to manipulate location for pricing advantages
4.5 LEGAL AND REGULATORY COMPLIANCE
- Follow all local, state, and federal laws regarding pesticide use, organic farming, and agricultural practices
- Obtain necessary permits and licenses for commercial agricultural operations
- Comply with food safety regulations if using the service for food crop production
- Respect intellectual property rights and do not reverse engineer or copy our AI models or algorithms
- Report any illegal activity or terms violations to our support team
5. PROHIBITED USES
You may NOT use the Services to:
5.1 UNAUTHORIZED COMMERCIAL ACTIVITIES
- Provide commercial plant diagnostic services without proper qualifications and licensing
- Resell AI analysis results or create competing plant disease detection services
- Distribute analysis results as professional agricultural advice without appropriate credentials
- Use the service to replace licensed agricultural consultants or certified crop advisors
- Market treatments or products based solely on AI recommendations without professional validation
5.2 DANGEROUS OR HARMFUL ACTIVITIES
- Make medical claims about plant-based treatments for human or animal consumption
- Distribute harmful, dangerous, or illegal treatment recommendations
- Promote pesticides or chemicals banned in local jurisdictions
- Provide food safety assessments for human consumption without proper certification
- Recommend treatments that could harm beneficial insects, soil health, or environmental systems
5.3 TECHNICAL ABUSE AND SECURITY VIOLATIONS
- Attempt to reverse engineer, copy, or access the underlying AI models or algorithms
- Circumvent subscription limitations, payment systems, or security measures
- Upload images containing malicious code, viruses, or other harmful software
- Use automated systems, bots, or scripts to access the service without permission
- Attempt to overwhelm servers, conduct denial of service attacks, or disrupt service availability
5.4 CONTENT AND PRIVACY VIOLATIONS
- Upload inappropriate, offensive, or illegal content including copyrighted materials
- Share personal information, faces, private property, or identifiable locations without consent
- Violate others' intellectual property rights or privacy through image uploads or data sharing
- Create fake accounts or impersonate other individuals or organizations
- Collect or store other users' personal information without explicit consent
5.5 LEGAL AND REGULATORY VIOLATIONS
- Use the service in violation of local agricultural regulations, pesticide laws, or environmental protection rules
- Provide advice that conflicts with organic certification requirements or sustainable farming practices
- Violate export control laws by sharing agricultural technology with restricted countries or entities
- Use the service for illegal activities including fraud, money laundering, or regulatory evasion
- Access the service from jurisdictions where use is prohibited by local law
6. SUBSCRIPTION TERMS AND BILLING

- Standard customer support response times
FREE TRIAL (Mobile-Only):
- 30-day trial period with 1000 AI scans per month
- Available once per user account
- Activated through mobile app only (not available on web platform)
- Automatic notifications at 6, 4, and 2 days before expiry
- Full premium features during trial period
- No credit card required for activation
- Can be converted to paid subscription anytime during trial
- Expires automatically after 30 days if not converted
PREMIUM SUBSCRIPTIONS:
- Monthly Premium: Unlimited scans, advanced features, priority support
- Yearly Premium: Annual billing with 17% savings (equivalent to 10 months pricing)
- Regional pricing automatically applied based on user location
- Premium features include:
* Unlimited AI crop scans (no monthly limits)
* Disease outbreak alerts within 50km radius (automated daily detection)
* Real-time push notifications for nearby disease outbreaks
* Advanced analytics dashboard
* Cloud backup and cross-device sync
* Team collaboration features (organisation subscriptions)
* Priority customer support with faster response times
* Export and reporting capabilities
6.2 BILLING AND PAYMENT PROCESSING
- All payments processed through Google Play Store (Android) or Apple App Store (iOS)
- CropCare does not directly handle credit card information or payment processing
- Subscriptions automatically renew unless cancelled through your app store account
- Billing cycles begin on subscription purchase date and renew monthly or yearly accordingly
- Taxes may apply based on your location and local tax regulations
6.3 SUBSCRIPTION MANAGEMENT AND CHANGES
- Upgrade, downgrade, or cancel subscriptions directly through Google Play Store or Apple App Store
- Free trial converts to paid subscription when user subscribes during trial period
- Trial expiry does not require cancellation - automatic reversion to free tier
- Subscription changes take effect at the next billing cycle
- Downgrades to free tier retain premium features until current billing period expires
- Account deletion immediately cancels subscription and prevents future billing
- Subscription sharing or account sharing is prohibited and may result in account termination
- Each user is limited to one free trial per account (lifetime limit)
6.4 REFUNDS AND CANCELLATION POLICY
- Refund policies governed by Google Play Store and Apple App Store terms
- Subscription cancellation prevents future billing but maintains access until period expires
- Partial refunds for unused subscription time handled according to app store policies
- Enterprise customers may have different refund terms specified in their service agreements

- Grace period: 7 days for failed payments before license suspension
- Subscription status: incomplete, active, past_due, unpaid, cancelled, expired, disabled
- Bulk license management: Create, assign, and revoke team member access
- Payment webhooks: Automatic subscription validation and license renewal
- Cancellation: Subscriptions remain active until end of billing period
- Dashboard analytics: Usage tracking, payment history, and team management
7. DATA COLLECTION AND STORAGE

- Web platform data hosted on secure cloud infrastructure with encryption at rest

7.4 THIRD-PARTY DATA SHARING
- GitHub Models API: Temporary image processing for AI analysis (images deleted immediately after processing)
- Google Play Store/Apple App Store: Subscription validation and billing management

9. INTELLECTUAL PROPERTY

- Our total liability to you for any damages is limited to the amount you paid for premium subscriptions in the 12 months preceding the claim

* Business interruption, lost profits, or opportunity costs
* Data loss not directly caused by our negligence

- We will attempt to maintain service continuity but cannot guarantee uninterrupted access during third-party changes
- Alternative service providers may be integrated to maintain functionality when necessary

12.5 ACCEPTANCE AND EFFECTIVE DATES
- Continued use of the Services after Terms updates constitutes acceptance of revised terms
- Users who disagree with updated Terms may terminate their account and discontinue service use
- Updated Terms become effective immediately upon posting unless otherwise specified
- Grace periods may be provided for significant changes affecting subscription terms or data processing
- Enterprise customers may have different update procedures specified in their service agreements
13. TERMINATION
13.1 USER-INITIATED TERMINATION
- You may terminate your account at any time through app settings or by contacting customer support
- Account deletion immediately cancels subscriptions and prevents future billing
- Uninstalling the mobile app does not automatically delete your account or cancel subscriptions
- Local data remains on your device until manually deleted or app is uninstalled
- Subscription cancellation must be completed through Google Play Store or Apple App Store
13.2 TERMINATION FOR CAUSE
We may suspend or terminate your account immediately for:
- Violation of these Terms of Service or acceptable use policies
- Fraudulent activity, subscription abuse, or payment disputes
- Uploading inappropriate, illegal, or harmful content
- Attempting to circumvent security measures or usage limitations
- Providing false information or impersonating others
- Repeated violations after warnings or temporary suspensions
13.3 SERVICE TERMINATION BY CROPCARE
- We reserve the right to discontinue the Services with reasonable advance notice (minimum 90 days for paid users)
- Service termination may be necessary due to:
* Changes in third-party service availability or pricing
* Technical, legal, or economic factors making service continuation unfeasible
* Regulatory requirements or compliance obligations
* Business restructuring or strategic decisions
- Users will receive prorated refunds for unused subscription time through app store policies
13.4 EFFECTS OF TERMINATION
Upon termination of your account:
- Access to all Services is immediately revoked
- Premium features and unlimited scans are no longer available
- Local data remains on your device until manually deleted
- Cloud-stored data (premium users) will be deleted within 90 days
- Subscription billing ceases according to app store cancellation policies
- You remain liable for any outstanding obligations or damages incurred before termination
13.5 DATA RECOVERY AND TRANSITION
- Export your analysis history and data before account termination
- Contact customer support within 30 days of termination for data recovery assistance
- Some data may be retained for legal, tax, or regulatory compliance purposes
- Business customers may have extended data retention periods specified in their agreements
- Third-party service data (AI analysis history) may not be recoverable after termination
14. GOVERNING LAW AND DISPUTE RESOLUTION
14.1 GOVERNING LAW
- These Terms are governed by the laws of Kenya, without regard to conflict of law principles
- Any legal proceedings must be conducted in Kenya unless otherwise specified in enterprise agreements
- International users acknowledge that Kenya law applies regardless of their location or citizenship
- EU users retain rights under European consumer protection laws where applicable
- California users retain rights under California consumer protection laws where applicable
14.2 DISPUTE RESOLUTION PROCESS
INFORMAL RESOLUTION:
- Before initiating formal proceedings, parties must attempt good faith negotiations for 60 days
- Contact customer support (hamez@hamez.dev) with detailed description of the dispute
- We will work diligently to resolve disputes through direct communication and reasonable accommodation
- Documentation of informal resolution attempts required before formal proceedings
BINDING ARBITRATION:
- Disputes that cannot be resolved informally will be subject to binding arbitration
- Arbitration conducted under Kenya Arbitration Act or internationally recognized arbitration rules
- Single arbitrator selected through mutual agreement or appointed by arbitration organization
- Arbitration location: Nairobi, Kenya, or virtual proceedings by mutual agreement
- Each party bears their own costs unless arbitrator determines otherwise
14.3 CLASS ACTION WAIVER
- You agree to resolve disputes individually and waive the right to participate in class actions, collective actions, or representative proceedings
- This waiver does not apply where prohibited by applicable consumer protection laws
- EU users retain rights to collective proceedings where provided by European law
- California users retain rights under California consumer protection statutes
14.4 EXCEPTIONS TO ARBITRATION
The following disputes are exempt from arbitration requirements:
- Small claims court proceedings within monetary limits
- Intellectual property disputes involving trademark, copyright, or trade secret claims
- Injunctive relief for terms violations or security breaches
- Disputes involving regulatory compliance or government enforcement actions
14.5 INTERNATIONAL JURISDICTION
- International users may pursue disputes in their local jurisdiction where consumer protection laws provide superior rights
- Enterprise customers may have specific jurisdiction clauses in their service agreements
- Regulatory investigations and compliance matters subject to applicable regulatory authority jurisdiction
- Data protection disputes subject to applicable data protection authority jurisdiction (GDPR, CCPA, etc.)

- Invalid provisions will be replaced with valid provisions that most closely reflect the original intent

16.2 ENTIRE AGREEMENT
- These Terms constitute the entire agreement between you and CropCare AI regarding use of the Services
- These Terms supersede all prior agreements, understandings, or communications regarding the subject matter
- Enterprise customers may have additional terms specified in separate service agreements
- Privacy Policy is incorporated by reference and forms part of the overall agreement
- Any modifications must be in writing and agreed to by both parties
16.3 ASSIGNMENT AND BINDING EFFECT
- You may not assign or transfer your rights under these Terms without written consent
- CropCare may assign these Terms in connection with mergers, acquisitions, or business transfers
- These Terms bind and benefit the parties and their respective successors and permitted assigns
- Assignment does not relieve original parties of existing obligations or liabilities
17. ACKNOWLEDGMENT AND EFFECTIVE DATE
17.1 USER ACKNOWLEDGMENT
BY USING CROPCARE AI SERVICES, YOU ACKNOWLEDGE THAT:
- You have read, understood, and agree to be bound by these Terms and Conditions
- You understand the limitations and disclaimers regarding AI analysis accuracy
- You acknowledge your responsibility to seek professional agricultural advice for critical decisions
- You agree to the subscription terms, billing procedures, and cancellation policies
- You consent to data collection, processing, and sharing as described in our Privacy Policy
17.2 EFFECTIVE DATE AND UPDATES
- These Terms are effective as of September 25, 2025
- Previous versions are superseded but may be referenced for historical context
- Users are responsible for reviewing updated Terms periodically
